Article 1: Preamble
The present general conditions of sale apply exclusively between ROM ERSA SARL - 3, rue F. de Blochausen - L-1243 Luxembourg - Luxembourg.

and any person visiting/making a purchase directly or via the www.thalus.lu website (hereinafter referred to as "You").
Any Internet user can read the general terms and conditions of sale on the site www.thalus.lu (hereinafter the "Site"). These general conditions of sale may be subject to change, the applicable conditions are those in force on the Site at the date of placing your order.
Article 2: Contract
2.1 Conditions for placing an order
Any order placed must correspond to the normal needs of a household.
2.2 Steps for concluding the contract
After placing your order, We send You an e-mail confirming the elements of your order and informing You of the possibility of modifying your order (in particular adding or deleting an item) and details on the processing of your data (RGPD) up to the date of dispatch of your items.
We inform You by e-mail of the dispatch of your items. This email constitutes our acceptance of your order and thus forms the contract of sale between Us and You.
Article 3: Price, availability and delivery.
Our prices are expressed in euros and include VAT: 3% included.
For any delivery abroad, transport and customs clearance costs must be added. In order for us to be able to make you a price offer for delivery in your country, please contact our customer service directly by phone + 352 661 960 900 or e-mail:

We can accept your orders while stocks last. We cannot give You any further details about this availability. The delivery times are mentioned as an indication and in no case We cannot guarantee You these delivery times.
If, despite our vigilance, the items are unavailable, We will inform You by e-mail as soon as possible. (i) In the event of unavailability within the indicated deadlines, We reserve the possibility of contacting You and of proposing another date to You. In the event that We could not provide You with this article, You will be able to cancel your order. (ii) In case of permanent unavailability, Your order will be automatically cancelled.
We remind You that Your payment card is only debited when Your order is dispatched. Therefore, in the event that the item is not available, your payment card will not be charged.
Despite our best efforts, it is possible that a limited number of the items on Our Site may contain a pricing error. However, please be assured that We proceed to price verification during the procedure of sending your item.
If the corrected price is lower than the price displayed on the Site, We will apply the lower price and send You Your item. If the corrected price is higher than the price displayed on the Site, We will inform You and proceed to cancel Your order unless You choose to accept the order at the new price.
Article 4: Customs duties
Any order placed online and delivered outside Luxembourg may be subject to possible taxes and customs duties that are imposed when the package reaches its destination. These customs duties and possible taxes related to the delivery of an item are at your expense and are your responsibility. We are not obliged to check and inform You of the applicable customs duties and taxes. To know them, We advise You to inquire with the competent authorities of your country.
Article 5 : Payment
You can pay for your order by bank transfer, when picking up your order directly or online by credit card.
Cards issued by banks domiciled outside Luxembourg must be international bank cards.
Article 6: Returns
Due to the nature of our product, water packed within a completely aseptic (bacteria free) filling process, we are unable to accept returns in case of product tampering.
We aim for 100% customer satisfaction, so please inspect your goods when received and notify us promptly (within 48 hours of receipt) either by phoning our office or by using the ‘contact us’ option on the website, if all is not as it should be.
Article 7: Retention of title
The goods delivered will remain our property until You have fulfilled all your obligations towards us, and in particular until full payment of the price.
Article 8: Guarantees and liability
We decline all responsibility in the event that the item delivered does not comply with the legislation of the country of delivery.
We commit ourselves to bring all the care in use in the profession. Nevertheless, we cannot be held liable in the event of a breach of our contractual obligations due to a fortuitous event or a case of force majeure as defined by the case law of the Luxembourg courts.
In the event of non-substantial differences between the photos presenting the products on our Site, texts and illustrations and the articles ordered, our responsibility will not be engaged.
We implement all the means at Our disposal to ensure the services that are the object of the present general conditions of sale. Under no circumstances shall We incur any liability for loss of profits, commercial loss, loss of data or loss of profit or any other indirect damage or damage that was not foreseeable at the time of use of the Site or the conclusion of the contract of sale between Us and You.
The limitation of liability referred to above shall not apply in the event of fraud or gross negligence on Our part, in the event of bodily injury or liability for defective products.
Article 9: Protection of personal data
We are committed to protecting Your personal data. All personal data concerning You that We have collected is treated with the strictest confidentiality, in accordance with the provisions of our personal data protection policy.
Article 10: Applicable law and competent jurisdiction
These general terms and conditions of sale are subject to Luxembourg law. All disputes relating to the commercial relationship between You and Us are subject to the exclusive jurisdiction of the Luxembourg courts.
